Maryland Opposes Federal Limits on Transgender Youth Healthcare

Maryland Attorney General Anthony G. Brown joined a coalition of 20 state attorneys general in submitting comment letters opposing two proposed rules from the United States Department of Health and Human Services and the Centers for Medicare and Medicaid Services that would restrict access to transgender healthcare for youth.

The rules, proposed in December 2025, would condition Medicare and Medicaid funding on hospitals and state programs not providing certain transgender-related care, potentially limiting services for young patients.

In their letters, Brown and the coalition argued that the proposed rules would interfere with states’ authority to regulate medical care and could result in significant funding losses for hospitals and providers. They also contended that the rules conflict with federal laws and constitutional provisions, rely on disputed research, and fail to adequately account for potential impacts on patients, families, and healthcare systems. Attorneys general from 19 other states and the District of Columbia joined in submitting the opposition.
