Montgomery County Introduces Vehicle Recovery Act to Assist Families After Federal Detentions

Montgomery County Councilmember Kate Stewart has introduced expedited legislation known as the Vehicle Recovery Act, aimed at reducing barriers for families seeking to recover vehicles after a loved one has been detained by federal immigration authorities.

County officials said an increase in federal detentions has led to vehicles being left in public areas and subsequently towed, creating financial and logistical challenges for families who are not listed on the vehicle title and are unable to retrieve the impounded cars. The proposed legislation would establish clearer procedures for vehicle redemption and require towing companies to accept alternative documentation demonstrating ownership or lawful possession.

Under the bill, vehicles could be released to a family or household member with a notarized letter from the owner, documentation from a lienholder, insurance provider, or rental company, or proof of shared residence or familial relationship along with valid photo identification. The legislation would also create enforcement mechanisms related to vehicle release and would sunset four years after taking effect. The measure is co-sponsored by the full Council, and a public hearing will be scheduled at a later date.
