Maryland Joins 24 States Opposing Executive Order on Birthright Citizenship

Maryland Attorney General Anthony Brown joined a coalition of 24 attorneys general in filing a brief with the Supreme Court of the United States defending birthright citizenship and opposing a 2025 executive order issued by President Donald Trump.

The order sought to end automatic citizenship for certain children born in the United States to immigrant parents. States challenged the order in federal courts in Washington and Massachusetts, where judges issued nationwide preliminary injunctions preventing it from taking effect.

The Supreme Court is now considering the issue in a case involving children who would lose citizenship under the order. The coalition argues the policy violates the Fourteenth Amendment and federal immigration law, which have long recognized birthright citizenship for children born in the United States regardless of their parents’ immigration status. Attorneys general from multiple states joined the filing, stating the order could affect thousands of children and have broader impacts on federal programs and state services tied to citizenship status.
