The Montgomery County Council has unanimously passed the Vehicle Recovery Act, an expedited measure aimed at reducing barriers for families seeking to recover impounded vehicles when the registered owner is not present. The legislation was introduced in response to an increase in federal immigration detentions, which can leave vehicles behind and create challenges for families attempting to retrieve them.
The new law establishes procedures for vehicle redemption and requires towing companies to accept alternative forms of documentation to verify ownership or lawful possession. Under the legislation, vehicles may be released to a family or household member with a notarized authorization letter from the owner or documentation from a lienholder, insurance provider, or rental company. In some cases, proof of identification, shared residence, or familial relationship may also be accepted.
County officials and community members said the legislation is intended to reduce hardship for families dealing with unexpected detentions and related challenges. The measure includes enforcement provisions for misconduct related to vehicle release, takes effect upon becoming law, and is set to sunset four years after its effective date.
