Maryland Attorney General Anthony G. Brown joined a bipartisan coalition of 19 attorneys general urging the U.S. Food and Drug Administration to withdraw proposed guidance that would make it easier for certain flavored e-cigarette products to receive federal approval.
The coalition argued that flavored vaping products continue to contribute to youth nicotine addiction and said research shows young people are more likely to use flavored tobacco products than unflavored options. The letter also criticized recent FDA actions, including the approval of two fruit-flavored e-cigarette products and an announcement that the agency would not prioritize enforcement against some unauthorized vaping products.
The attorneys general called on the FDA to continue closely reviewing flavored e-cigarette applications in the interest of public health. Brown’s office also highlighted previous efforts to combat youth tobacco and vaping addiction, including the 1998 national tobacco settlement and Maryland’s participation in a 2022 multistate settlement with JUUL Labs over the company’s marketing and sales practices. Attorneys general from states including California, New York, Pennsylvania, and Massachusetts also joined the letter.
