Council Committee to Review Misconduct Findings Involving Former Police Chief Marc Yamada

The Montgomery County Council’s Audit Committee will meet on Friday, October 23, at 2:30 p.m. to review two Office of the Inspector General (OIG) investigations involving alleged misconduct by a Montgomery County Police Department (MCPD) executive and an employee of the Office of the County Attorney.

The first investigation involves former Montgomery County Police Chief Marc Yamada, who resigned on September 18 after County Executive Marc Elrich requested his resignation following the release of the OIG report. Although the report did not identify Yamada by name, Elrich subsequently confirmed that its findings prompted his decision to seek a change in police leadership.

Investigators found that the executive failed to record leave for at least 40 hours of absences, made a false statement regarding the selection of a County-employed relative for an out-of-state work conference and authorized the use of a County vehicle by an Office of the County Attorney employee without establishing appropriate restrictions.

The second investigation concerns an Office of the County Attorney employee accused in anonymous complaints of participating in official travel outside the scope of their duties and directing an MCPD executive to use the encrypted messaging application Signal for County business to avoid public records requirements. A separate complaint alleged that the employee was involved in a motor vehicle accident while potentially under the influence of alcohol and failed to properly report the incident. These allegations were the subjects of an OIG investigation and should not be interpreted as established findings.

The Audit Committee consists of Councilmembers Kate Stewart, Natali Fani-González, Marilyn Balcombe, Shebra Evans and Sidney Katz. Members will review both investigative reports and their findings during Friday’s meeting.
