No Charges Filed Against Gaithersburg Officers After In-Custody Death Investigation

Maryland Attorney General Anthony G. Brown announced that no charges will be filed against Gaithersburg police officers involved in the  December 24, 2024, in-custody death of Marvin Salamanca Garcia after an investigation concluded the officers did not commit a crime under state law.

Per the news release distributed on Friday, August 22: “Today, Attorney General Anthony G. Brown announced his decision not to seek charges in the Tuesday, December 24, 2024, officer-involved in-custody death that occurred in Gaithersburg, Montgomery County, Maryland.

On Tuesday, December 24, 2024, at approximately 10:28 p.m., Gaithersburg Police Department (GPD) officers responded to a 911 call reporting that a man was causing a disturbance in the 300 block of Summit Avenue in Gaithersburg. Upon arrival, officers encountered a man, later identified as Marvin Salamanca Garcia, in the entryway of an apartment building.

He was covered in blood and exhibiting erratic behavior. Salamanca Garcia exited the building and approached officers while speaking incoherently and moving his arms in a manner that caused blood to spatter. GPD officers restrained Salamanca Garcia by placing and holding him on the ground while awaiting emergency medical services. During this time, Salamanca Garcia lost consciousness and stopped breathing. Officers rendered medical aid until medics arrived on the scene. Salamanca Garcia was transported to a local hospital, where, on December 26, 2024, he was pronounced deceased.

The Attorney General’s Independent Investigations Division (IID) began investigating the officer-involved in-custody death on December 24, 2024, and concluded its investigation on August 13, 2025. After completing its investigation and evaluating all available evidence, the Office of the Attorney General determined that the subject officers did not commit a crime under Maryland law. Accordingly, the Attorney General has declined to prosecute any of the officers in this case.
