MoCo DHHS Sends Letter to Restaurants Informing Them They Cannot Sell Food Infused With Cannabis/CBD/THC

The Montgomery County Department of Health and Human Services has sent a letter to restaurant facilitators informing/reminding them that they cannot add cannabis, CBD, or THC to any food or drink they serve because it has not been approved as a food additive by the FDA, despite its current legal status in the state. The letter can be seen below:

“Dear Facility Operator,

The Maryland Department of Health (MDH) wants you to be aware of the current legal status of cannabidiols (CBD), THC, and cannabis, and facilities licensed by the Maryland Department of Health (MDH) Office of Food Protection. CBD. THC, and cannabis have not been approved as food additives by either the U.S. Food and Drug Administration (FDA) or MDH. Therefore, foods and beverages offered for sale that have either been made with CBD, THC, or cannabis, or in which CBD, THC, or cannabis has been added in any way are considered adulterated and are not to be sold or served by a licensed food establishment.

Edible cannabis products may not be marketed or offered for sale as foods. Cannabis dispensaries and edible cannabis products are licensed and regulated by the Maryland Cannabis Administration (MCA). Please refer to MCA for more information about licensure regarding edible cannabis products.

Additionally, under the Food Drug and Cosmetic Act, foods containing CBD, THC, and cannabis may not be sold in interstate commerce. Foods and beverages obtained from a company outside of the State of Maryland containing CBD or cannabis should not be offered for sale. MDH is aware of the interest of retail food service facilities in adding CBD and cannabis to foods and beverages. In January 2023, the FDA concluded that a new regulatory framework is needed to regulate CBD products, including the use of CBD in foods.
