
A Montgomery Village man was sentenced today for the attempted first-degree rape of a 14-year-old girl in 2021.
According to the Montgomery County State’s Attorney’s Office, “today in the Circuit Court for Montgomery County, MD, the Honorable Bibi Berry sentenced defendant, Jose Oliva-Marin, 26, of Montgomery Village, MD to 15 years in prison suspend all but nine years to serve and five years of supervised probation upon release. Oliva-Marin will be required to register as a sex offender for life.
Oliva-Marin pleaded guilty to attempted first-degree rape on November 6, 2023, for an attack on a 14-year-old girl inside of her family’s apartment in October of 2021. The defendant broke in through the victim’s bedroom window. She attempted to flee the room, and he physically assaulted her saying in Spanish, “Make love to me or die.” The victim was able to escape out of the bedroom and the defendant left. Family members contacted 911. The defendant was apprehended a short time later in the apartment complex and was linked to the case through DNA and addition evidence. He was known to the victim’s mother.
Assistant State’s Attorneys Mary Herdman and Dermot Garrett prosecuted this case.
“This tremendously brave young girl endured a terrifying ordeal. We thank her for her cooperation in this case and we are grateful that the defendant has been sentenced to a significant period of time,” said State’s Attorney John McCarthy.
