A Gaithersburg man has been sentenced to 14 years in federal prison after selling fentanyl to a 15-year-old girl who later died from an overdose, according to the U.S. Attorney’s Office for the District of Maryland.
U.S. District Judge Deborah L. Boardman sentenced Kelvin Reyes, 27, to 14 years in federal prison followed by five years of supervised release for distribution of controlled substances.
According to court documents, the 15-year-old contacted Reyes through Instagram late on January 13, 2023, about purchasing fentanyl. Reyes agreed to sell her the drug and requested an address for delivery. The girl instructed him to meet her at an elementary school near her home in Montgomery County.
Investigators determined that Reyes’s phone was at the school during the early morning hours of January 14. Ring camera footage from the girl’s residence showed her leaving home around the same time and returning approximately three minutes later. Authorities said Reyes subsequently posted an Instagram story advertising that he was driving around selling fentanyl.
At approximately 7am, the girl’s mother found her daughter in her bedroom in a fetal position with fluid coming from her mouth and nose. A burnt piece of aluminum foil containing fentanyl residue was found next to her, according to court documents. An autopsy determined that the girl died from fentanyl and despropionyl fentanyl intoxication.
Ten days later, on January 24, law enforcement executed a search warrant at Reyes’s residence. Investigators recovered a digital scale, clear plastic bags, numerous orange zip-top bags, foil and straws containing residue, along with a plastic bag containing $5.13 in coins.
The sentence was announced by U.S. Attorney for the District of Maryland Kelly O. Hayes along with officials from the DEA Washington Division, FBI Baltimore Field Office and Montgomery County Police Department. The U.S. Attorney press releases do not include mugshots.
