On Friday Maryland’s highest court granted Lee Boyd Malvo, the now 37-year-old convicted D.C. sniper, a new sentencing hearing. In 2006, a Montgomery County Circuit Court judge sentenced Malvo, who pleaded guilty, to six life sentences without the possibility of parole for his role in the killing of six people. In a 4-3 ruling filed Friday, the Maryland Court of Appeals determined Malvo was due a new sentencing hearing, citing the 2012 Supreme Court case Miller v. Alabama, which says life sentences without the possibility of parole for juveniles violate the Eighth Amendment.

Malvo was 17 years old when he and John Allen Muhammad (41-years-old) began a killing spree in DC, Maryland and Virginia for a three week period in October 2002 before they were arrested later that month at a Maryland rest stop. Muhammad was executed in 2009 for his role in the shootings.  In 2017, Malvo filed a motion to correct what he claimed was an illegal sentence under a Maryland law, based on a 2012 US Supreme Court ruling barring mandatory life sentences without parole for juvenile offenders. Per court documents, “Recent Supreme Court decisions have held that the Eighth Amendment to the United States Constitution does not permit a sentence of life without parole for a juvenile offender convicted of homicide if the sentencing court determines that the offender’s crime was the result of transient immaturity, as opposed to permanent incorrigibility. That constitutional constraint applies retroactively. However, a court that imposes a sentence in a discretionary sentencing regime need not make an explicit finding as to a juvenile offender’s incorrigibility. In a case where sentencing took place prior to the recent Supreme Court decisions and where the sentencing judge may have determined that the defendant was not permanently incorrigible, the defendant is entitled to be resentenced to ensure compliance with the Eighth Amendment. The terms of that sentence remain within the discretion of the sentencing court.


Federal, State, and Local Law Enforcement Leaders Renew Commitment to Fight Violent Crime Together

Per the U.S. Attorney’s Office, District of Maryland: U.S. District Judge George L. Russell, III sentenced Scott Eli Harris, age 52, of Aubrey, Texas, yesterday to six months in federal prison, followed by three years of supervised release, for sending a threatening message to a Maryland medical doctor who publicly advocated for the COVID-19 vaccine.

The sentence was announced by United States Attorney for the District of Maryland Erek L. Barron; Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division; and Special Agent in Charge Thomas J. Sobocinski of the Federal Bureau of Investigation, Baltimore Field Office.


A 34-year-old Virginia man has been arrested and charged with sexual solicitation of a minor after he attempted to meet up with who he thought was a teenage girl.

On Thursday, August 11, 2022, Jose M. Jimenez of McLean, VA, initiated a conversation on a social media site with a Montgomery County Detective posing as a 15-year-old girl. The next day, Jimenez and the detective exchanged messages and phone numbers, eventually agreeing to meet in person. Jimenez asked the “girl” her age and continued to have sexually explicit text conversations with her.


Per MCPD: 34-year-old Jeniffer Vallecillo of Gaithersburg has been indicted on vehicular manslaughter and homicide while under the influence of alcohol charges, following a fatal two-vehicle collision at Midcounty Hwy and Saybrooke Oaks Blvd. on Monday, November 29, 2021.

Vallecillo was driving a 2021 Toyota Camry when her vehicle collided with 49-year-old Anupom Ghosh of Gaithersburg, who was driving a 2018 Honda CRV. The vehicles collided in the intersection of southbound Midcounty Hwy, and Saybrooke Oaks Blvd. Ghosh was transported to an area hospital, where he later died.


75-year-old Robert Worrell of Brookeville, MD, was indicted on Thursday, July 28, 2022, on felony hit and run charges, after fatally striking 64-year-old Robert Lawrence, the morning of Friday, August 11, 2020, with his Ford F-250 in the 4100 block of Bel Pre Rd. in Silver Spring.

Lawrence, of Silver Spring, was transported to an area hospital, where he died three days later. During the course of the investigation, Montgomery County Collision Reconstruction Unit (CRU) detectives were able to obtain evidence identifying Worrell as the driver of the truck that struck and killed Lawrence.


On Friday, August 19th in the Circuit Court for Montgomery County, MD, Judge David Boynton sentenced defendant, Noe Daniel Suriel, 29, of Silver Spring to five years in prison for his role in the death of Rene Antonio Hernandez Jr. Additional details can be found below in the press release sent out at the time of conviction:

In the Circuit Court for Montgomery County, MD, before the honorable Judge David Boynton, a jury has found defendant, Noe Daniel Suriel, 29, of Silver Spring, guilty of Driving a Motor Vehicle in a Race or Speed Contest and Gross Negligent Manslaughter by Motor Vehicle for the death of Rene Antonio Hernandez Jr., 32, of Olney. Suriel is facing a maximum of 10-years in prison. A sentencing hearing is scheduled for August 19th, 2022. The verdict came in late last night and stems from Suriel’s role in a multiple-vehicle fatal collision that occurred on September 6th, 2019, along Georgia Avenue at an entrance ramp for MD 200 (the Intercounty Connector- ICC).


Per MCPD: Detectives from the Montgomery County Department of Police- 3rd District Investigative Section have arrested and charged 41-year-old Terry Claude Tompkins of Temple Hills, MD for the Saturday, July 30, 2022, for the strong-armed robbery of an employee of the Ace Hardware store in the 800 block of Wayne Avenue. At approximately 4 p.m., 3rd District officers responded to the above location for a shoplifting in progress.

The investigation by detectives determined that the suspect entered the hardware store and began stealing multiple electrical cable and wire items. When the store employee confronted the suspect, the suspect then assaulted the employee and took the employee’s cell phone. Through the course of the investigation, detectives were able to identify Terry Claude Tompkins as the suspect.


Detectives from the Montgomery County Police – 6th District Investigative Section are currently investigating a Montgomery Village shooting. Detectives have released a sketch of the male suspect and are asking for the public’s assistance in identifying him (available below).

On Tuesday, August 16, 2022, at approximately 11:30 p.m., Montgomery County Police – 6th District officers responded to the 18300 block of Lost Knife Circle for the report of a shooting that just occurred. Upon arrival, officers located a juvenile male suffering from multiple suspected gunshot wounds. The victim was transported to an area hospital in critical condition.


Per the U.S. Attorney’s Office, District of Maryland: U.S. District Judge Theodore D. Chuang sentenced Marion Rose Payne, age 55, of Harwood, Maryland, on August 15, 2022, to 15 months in federal prison, followed by three years of supervised release, for conspiracy to produce and transfer identification documents without lawful authority, specifically, Maryland driver’s licenses.  Judge Chuang also ordered Payne to forfeit $25,000, which constitutes the proceeds of Payne’s participation in the criminal conspiracy.

The sentence was announced by United States Attorney for the District of Maryland Erek L. Barron and Special Agent in Charge James C. Harris of Homeland Security Investigations (HSI) Baltimore.


Nesredin Esleiman of Silver Spring is described as “a devoted Muslim family man, loved by his community, friends and family.” According to a GoFundMe started to raise money for his family, the Montgomery County man was working as an Uber driver when he was shot and killed on Wednesday, August 10, in what police describes as an attempted robbery. Mr. Esleiman has left behind a wife and three children.
